Annulment

An annulment is a proceeding to invalidate a marriage. Certain time limitations may apply to these lawsuits.

An annulment suit may be brought if:

• One party is underage, and did not have parental consent or a Court Order permitting the marriage to take place;
• The party seeking the annulment was under the influence of drugs or alcohol at the time of the marriage;
• A party is permanently impotent, and did not disclose his/her impotency to the other spouse before the marriage;
• A party was induced to marry by fraud, duress, or force;
• A party lacked the mental capacity to consent to marriage;
• A party concealed a divorce that occurred within 30 days before the marriage.
